Terms of Home Sweet Home

  1. Terms

    The real estate agency Home Sweet Home is any natural or legal entity indulged in real estate business in the Czech Republic, which is on the basis of franchise contract entitled to use the system of Home Sweet Home. Each real estate agency Home Sweet Home is owned and operated independently.

    The real estate broker is a person trained within the system of Home Sweet Home, independently indulged in real estate business in the Czech Republic, that is contractually obliged to some of the real estate agencies Home Sweet Home and on the basis of a contract is entitled to use the system of Home Sweet Home.

    The client is any natural of legal entity to which any of the real estate agencies Home Sweet Home or any of the real estates brokers provide real estate services.

    The contract is a contract on providing real estate services (brokerage of sale or rental of real property) entered by and between a concrete real estate agency Home Sweet Home and the client.

  2. Ethical code

    While providing their services, the real estate agencies Home Sweet Home and its real estate brokers act in accordance with the client’s interest and in their activities are governed by the legal order of the Czech Republic and by Ethical code of Home Sweet Home.

  3. Brokerage contract

    The real estate agencies Home Sweet Home and its real estate brokers provide real estate services only on the basis of written contract. All guaranties and advantages provided to the client within the system of Home Sweet Home are conditioned by entering into a written contract.

  4. Brokerage fee

    For providing real estate services, the real estate agencies Home Sweet Home and its real estate brokers are entitled to a brokerage fee (provision) specified in the brokerage contract. Without the client´s request, the real estate agency Home Sweet Home and its real estate brokers are obliged to issue and hand over to the client a proper tax document billing brokerage fee (provision) containing besides all legal requirements the appropriate amount of VAT, in case that the real estate agency is a taxpayer. The brokerage fee comprises compensation for brokering the sale / rental of the real property and covers the Minimum range of services regardless the concrete extend of services used by the client.

  5. Escrow services and deposit accounts

    The real estate agencies Home Sweet Home and its real estate brokers are entitled to offer to the clients solely Notary or Attorney Escrow Services recommended by the Home Sweet Home headquarters. The real estate agencies Home Sweet Home are obliged to maintain a separate bank account to which financial means of the clients are transferred.

  6. State of the real property

    The real estate agencies Home Sweet Home or its real estate brokers are not liable for any damage caused in case that the client has concealed or given untrue information regarding the state of the real estate property.

  7. Obligation to inform

    Through the validity of the contract, the real estate agencies Home Sweet Home and its real estate brokers regularly inform the client about the state of ordered services.

  8. Warranty claim

    The real estate agencies Home Sweet Home are obliged to always conform with the warranty guidelines of Home Sweet Home and handle any remark or complaint of the client without undue delay.

  9. Obligatory damage liability insurance

    The real estate agency Home Sweet Home and its real estate brokers are obliged to have damage liability insurance. Potential damage caused by the real estate agency Home Sweet Home or by its real estate brokers to the client’s property during the business transaction shall be covered by this insurance.

  10. Duty to identify

    The real estate agencies Home Sweet Home, pursuant to the Act No. 253/2008 Coll., on selected measures against legitimatization of crime and financing of terrorism, as amended, are persons bound by law and are obliged to identify the client and keep identification data for statutory time.
